Is Attorney General Holder a hypocrite for appointing a prosecutor for the CIA, but not for Al Gore's felony?

When Al Gore was running for President in 2000, he committed a felony by campaigning from his Government office as Vice President. His defense was that there was no controlling legal authority, or no case law. That defense was bought by istant AG Holder, now he is appointing a prosecutor to investigate the CIA, in another case with no case history, or in the words of Al Bore, no controlling legal authority. Sounds pretty hypocritical to me.
